The main question is whether a Contracting authority is obligated to place orders under a framework agreement when purchasing a product or service that is covered in that agreement and to what extent a contractor is obligated to accept such orders. If the answer to that first question is that an obligation does exist the next question to arise is what kind of consequences to expect when either party fails to meet that obligation. Of great importance is whether a Contracting authority that hasn?t used an existing framework agreement is liable to pay damages to the contractor who according to the agreement had a right to deliver.

I samarbete med SIEMENS AB Building Technologies har jag tittat på hur man kan garantera en viss nivå på besparingarna som genomförs. Denna garanterade besparing beräknas mot en uppställd baslinje, som är en beräkning av hur energianvändningsmönstret skulle ha sett ut med dagens förutsättningar om inga förändringar gjorts. The frequency of innovative procurement is currently very low in Sweden. Innovative procurement is to procure unknown solutions to a defined problem or need for which it sometimes has not yet been established on the market.  Current Swedish procurement legislation does not prevent innovation procurement, however, it limits official authorities to actively work with innovative companies to develop new solutions. Furthermore, some conflicts arise between the Swedish procurement legislation and the basic principles concerning public procurement developed under EU law, which must be considered in all procurements. Additionally, there is not a specific procurement procedure designed for innovative solutions in the current legislation.On the 15th of January 2014 three new directives on procurement rules were adopted with the general objective to simplify the procurement process and to make the whole system more flexible. A new procurement procedure has also arisen called innovation partnership.

This is a study with a qualitative approach and a social psychological perspective. Our purpose is to describe and analyze authority officials descriptions of individuals with a social disability and their perception of how the interaction in the encounter with its implementation. We are interested in how they experience their power as authority representatives. The following issues are highlighted.? How do people in authority describe individuals with a social disability?? What is the authority officials view on the interaction in meetings with individuals with a social disability?? How do authority officials experiencing his or her position of power in relation to the meeting?Our results are based on semi-structured interviews with five persons in authority, which is active in Insurance and Employment Service in Örebro County.

The number of silvicultural contractors has significantly increased in the last decades, and among its main clients are the forest companies. The purpose with this study was to describe the contractors that worked with planting in Norrbotten and Västerbotten in 2009 for Holmen Skog, Norra Skogsägarna, SCA Skog and Sveaskog and also examine if there was any correlation between the contractors? competence and the quality in the planting they achieved. A survey was made among 47 contractors with a questionnaire who performed planting for the forestry companies in 2009. 27 contractors answered the questionnaire and 4 representatives of these contracting companies took part in an extensive interview.

To achieve this purpose we have chosen to use a qualitative method with deliberation interviews. The interviews have been implemented with six different persons in authority who work in social welfare offices and as LSS - administrators.Ensured to our questions, (1) How does persons in authority do in the meeting with persons that has a disability and chooses to become parents? (2) Which possibilities respective difficulties see persons in authority within social service and LSS with parenthood where the parent has a disability? (3) What is done in order to facilitate the needs that are added when persons with disabilities chooses to become parents? we consider that they have been responded to.Through our empirical materials we can interpret and read out the replies that we searched for in connection with our survey.

When Swedish authorities are to purchase or rent something, public procurement is used as a means to an end. Authorities as well as suppliers are subjects to the fact that Swedish law regarding public procurement regulates the form of procurement in one set of particular regulations (LOU) and the form of contracts in another set of general regulations (AvtL). Suppliers and purchasing authorities close a contract regarding the subject of procurement and the law of public procurement regulates when such a contract can be closed, simultaneously the law of contracts regulates when parties are held to contracts and when contracts are to be rescinded. I investigate in this essay what these two types of regulations can result in for the contracting parties. As it is today agreements that have been entered into wrongfully still are valid, even if a court of law nullifies the procurement and sentences the purchasing authority to make a new public procurement.
